Kesalz provides Voice over Internet Protocol (VoIP) services, which enable users to make voice calls over the internet. By using Kesalz’s VoIP services, you agree to:
• Comply with all local, state, and national regulations governing telecommunications, including laws related to emergency services and call identification.
• Use the VoIP services only for lawful purposes and refrain from engaging in any disruptive or illegal activities that may harm Kesalz's network or other users.
• Understand that while Kesalz strives to maintain a high level of service uptime, VoIP services are dependent on internet connectivity, and Kesalz does not guarantee uninterrupted service or voice quality at all times.
Kesalz provides managed IT services, offering proactive management, monitoring, and maintenance of IT infrastructure. By engaging in our IT services, you agree to:
• Provide accurate and timely information related to your IT environment.
• Allow Kesalz’s team to access your systems as needed to perform diagnostics, updates, and other necessary activities.
• Acknowledge that any downtime or disruptions resulting from third-party software, hardware issues, or natural disasters are outside of Kesalz's control.
Kesalz offers software development services, including custom software solutions tailored to your business needs. By utilizing these services, you agree to:
• Provide Kesalz with clear project requirements, timelines, and necessary resources to ensure successful project execution.
• Acknowledge that software development projects are subject to changes in scope and timelines based on mutual agreement and unforeseen technical challenges.
• Understand that Kesalz cannot guarantee the full security of third-party integrations or applications outside of the scope of Kesalz’s development efforts.
Kesalz offers social media boost services to enhance your online presence. By utilizing these services, you agree to:
• Ensure that the content provided for social media promotion is in compliance with all applicable laws and regulations.
• Acknowledge that Kesalz cannot guarantee a specific outcome from social media marketing or a particular number of followers, likes, or engagement.
As a client, you are responsible for:
• Providing all necessary access, information, and cooperation to enable Kesalz to perform the agreed-upon services effectively.
• Maintaining the confidentiality and security of your user credentials, data, and any sensitive information shared with Kesalz.
• Complying with applicable laws and regulations while using Kesalz’s services.
• Fees for Kesalz’s services will be outlined in the service agreement provided to you.
• Payments are due according to the terms agreed upon in your service contract.
• Late payments may incur additional fees, and Kesalz reserves the right to suspend or terminate services if payment is not received on time.
• Kesalz is committed to protecting your privacy and maintaining the confidentiality of personal and business data shared during the course of service delivery.
• Our cybersecurity practices include encryption, access control, and compliance with data protection laws. However, as the user, you are responsible for ensuring that sensitive data is appropriately secured at all times.
Kesalz will not be liable for any indirect, incidental, special, or consequential damages arising out of the use of our services, including, but not limited to, data loss, business interruption, or loss of revenue.
• Either party may terminate the agreement with written notice if the other party fails to fulfill any material obligation under these Terms of Service.
• Kesalz reserves the right to suspend or terminate your access to services if you breach any of the terms outlined in this agreement, particularly those related to cybersecurity and lawful use of services.
You agree to indemnify and hold harmless Kesalz, its employees, agents, and partners from any claims, damages, or losses arising from your use of our services, including but not limited to any breaches of cybersecurity, VoIP misuse, or violations of local laws.
Kesalz reserves the right to update or modify these Terms of Service at any time. Any changes will be communicated to you, and continued use of the services will constitute acceptance of those changes.
These Terms of Service are governed by and construed in accordance with the laws of California. Any disputes related to these terms will be subject to the exclusive jurisdiction of the courts in California.
